Terms of Service

1. Entity & Agreement: DomainSignal.io is a service operated by Sawtooth Logic Systems LLC ('Company', 'we', 'us'). By accessing our API or website, you agree to these legally binding Terms.

2. Passive Diagnostic Service: DomainSignal is a passive network diagnostic and public-infrastructure intelligence service. We query publicly observable DNS, identity-discovery, and mail-routing records. DomainSignal does not transmit, route, inject, queue, or schedule electronic mail on your behalf. We do not operate an MTA, sequencer, or mailbox. Any outbound messages you send are solely your activity on third-party systems you control.

3. Service Nature: DomainSignal provides automated, real-time domain infrastructure telemetry, DNS-over-HTTPS lookups, and publicly advertised identity-protocol signals. We do not guarantee the deliverability, inbox placement, or business outcome of any external email campaign.

4. License & Credits: Purchased or provisioned API credits represent a limited, revocable, non-exclusive, non-transferable license to query our edge API. Credits have no cash value and are consumed upon query execution. Credits do not expire.

5. CAN-SPAM, CASL, and GDPR warranty: You represent and warrant that any email outreach, lead list, or campaign you conduct using intelligence obtained from DomainSignal complies with the U.S. CAN-SPAM Act, Canada's CASL, the EU GDPR and ePrivacy rules, and all other applicable marketing, privacy, and electronic-communications laws. You are solely responsible for consent, identification, opt-out, and lawful basis for processing personal data of recipients.

6. Prohibited uses: You will not use DomainSignal, or any data derived from it, to engage in phishing, credential harvesting, malware delivery, social-engineering attacks, unauthorized access to computer systems, or unsolicited bulk commercial email (spam). You will not use the service to evade, disable, or interfere with a recipient's security controls. You will not reverse-engineer the API, launch denial-of-service attacks, or flood our edge infrastructure.

7. Absolute Disclaimer of Warranties: THE SERVICE IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. SAWTOOTH LOGIC SYSTEMS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

8. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SAWTOOTH LOGIC SYSTEMS LLC, ITS DIRECTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR INBOX REPUTATION. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT PAID BY YOU IN THE PRIOR THREE (3) MONTHS.

9. Customer indemnification: You agree to indemnify, defend, and hold harmless Sawtooth Logic Systems LLC, its officers, contractors, and affiliates from any third-party claims, damages, fines, or legal expenses arising from (a) your outbound email campaigns or sales sequences, (b) your lead lists or personal data, (c) your violation of these Terms or of CAN-SPAM, CASL, GDPR, or similar law, or (d) any allegation that messages you sent constitute spam, phishing, or unauthorized marketing.

10. Governing Law & Arbitration: These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding individual arbitration, waiving any right to class actions.
